  • Florida Independent Contractor Agreement

    Worker-classification test
Reemployment tax uses the common-law employer-employee rules. Workers' comp has its own test: a non-construction contractor generally must meet four of six statutory criteria.
    Written contract required?
Not required by state law, but some workers' comp exclusions need a writing, such as real estate licensees paid solely by commission under a written agreement.
    Misclassification penalties
Failing to cover misclassified employees under workers' comp brings a stop-work order and a penalty of twice the premium owed for the prior 12 months (24 for repeat offenders), minimum $1,000.

  • Florida Non-Compete Agreement

    Updated for § 542.335

    Are employee non-competes enforceable?
Yes. Florida enforces non-competes in a signed writing that protect a legitimate business interest and are reasonable in time, area and line of business. Courts must narrow overbroad terms.
    Governing law
Fla. Stat. § 542.335 for most agreements; the CHOICE Act (Fla. Stat. §§ 542.43–542.45, ch. 2025-213) for covered agreements with higher earners, effective July 2025.
    Salary or wage threshold
None under § 542.335. CHOICE Act covered agreements apply only to employees earning more than twice the annual mean wage of the relevant Florida county; health care practitioners are excluded.
